Key Responsibilities
* Drive medico-legal processes by assessing and processing requests, including subpoenas, police requests, and court orders, to ensure timely release of patient health information.
* Architect financial dispute resolutions by providing expert legal advisory support to management and ensuring compliance with relevant legislation.
* Champion privacy compliance by verifying the appropriateness of information release requests, confirming patient consent, and maintaining accurate disclosure records.
* Lead subject access requests, ensuring patients receive copies of their medical records within legislative timelines.
* Manage a caseload of clinical negligence and personal injury claims, including statement preparation, expert evidence analysis, and coordination with insurers.
* Coordinate hospital involvement in coronial inquests, including evidence review, staff preparation, and witness support.
* Foster relationships with external counsel, insurers, and courts to track case progress, costs, and outcomes.
* Conduct incident reviews to assess medico-legal exposure and inform risk management strategies.
* Draft, review, and negotiate hospital contracts, including service agreements and partnership agreements, to ensure compliance and minimize risk.
* Develop and maintain a centralized contract register with key terms, expiry dates, and risk flags.
* Collaborate on policy development, reviewing hospital policies, procedures, and consent frameworks to ensure legal compliance.
* Provide expert advice on healthcare regulations, data protection laws, and governance support to management committees.
* Support compliance with data protection laws, advising on data breaches and mitigation actions.
* Offer advisory support on disciplinary cases, grievances, terminations, and consultant complaints, ensuring compliance with employment laws and collective bargaining agreements.
* Facilitate dispute resolution in labor disputes and conciliation proceedings.
* Conduct legal research and analysis to support various legal matters, providing actionable insights and recommendations.
* Develop and implement effective risk management strategies to mitigate medico-legal exposure and ensure regulatory compliance.
